THE LEGAL CASE
This is by most legal judgment a unique case in Canadian jurisprudence. It is so because almost all cases where conscientious tax objectors refuse to file or pay taxes are objecting to military spending, being opposed to all war. These persons have been few in number and often persons of the Quaker faith, a tiny denomination in Canada.
This case affects all Canadians who pay taxes by income or by GST, HST or any sales tax. This is of course, because universal public funded Medicare also includes the elective medical procedure called direct induced abortion, euphemistically called "therapeutic abortion" by the government and its agencies.
In late summer of 2004, David Little, who was born in Canada and has lived there his entire life of 60 years, left his employ as Vice President of a Catholic charity in the United States to start a new organization called The St. Thomas More Society of Canada (STMS). The mission was to raise resources of both persons and funds to take pro-active measures against the government of Canada, legally and politically; to end tax funded abortion in the short term, and to reverse the legality of all abortion in the long term. Other issues of great concern to STMS include the sanctity of true marriage, the rot in most sex ed programs, embryonic stem cell and in vitro research and cloning issues and the decline generally in society and churches of real, history-tested Christian teaching.
This particular case began in August 2003 after David had written the following letter to the Prime Minister of Canada, Jean Chretien the previous month.

Dear Mr. Chretien,
Though I know correct protocol is to address you as Right Honourable, I cannot bring myself to do so, because I am so utterly ashamed of you, so terribly scandalized by your words and actions. You are an extreme embarrassment and humiliation to millions of practicing Catholics not only in Canada but throughout the world. It is mortally sinful for a Catholic to promote moral views contrary to formal Church teachings, which are of course the irrefutable teachings of Christ Himself. It is doubly wrong when one is a leader of a nation for the sin of scandal is so much greater. You have declared yourself a Catholic who believes in abortion. You sir, are no Catholic. You have declared yourself in favour of "marriage" for persons of the same gender, a position totally barren of even the slightest semblance of common sense, truth or historical integrity, let alone Catholic doctrine. You Mr. Chretien are assuredly no Catholic.
For 2000 years Christ has taught through His Church that abortion is the murder of an innocent child and that the sanctity of sexual intimacy is reserved solely for a man and woman who embrace and are bound by the bonds of matrimony. Yet while claiming Catholicity, you sanction homosexual acts and publicly promote murder of the most innocent in the womb. You have the gall to call yourself a Catholic as you promulgate and support 'laws' that denigrate matrimony, promote perversity and slaughter unborn human beings! Such astonishing hypocrisy!
Here is the simple unvarnished truth, Mr. Jean Chretien. You sir, are quite certainly not even Christian, let alone a Catholic. Please abandon the gross hypocrisy of calling yourself a Catholic for it is a most apparent lie. As a leader, you have done incalculable harm to the souls of not only Canadians but humanity at large. You sadden and sicken me. You are a disgrace to simple decency and I fear for your soul. You try to clothe yourself with the sanctity of Catholicism while your words and deeds reek with the stench of evil.
I implore you to repent before it is too late, for you will be judged, as will we all, by every word that comes out of your mouth. I will pray for you.

Six weeks later a tax collector knocked on Mr. Little's door at his family home and presented him with five separate demand letters all saying the same thing. File your income tax for the years 1999, 2000, 2001, 2002 and 2003 or face penalties and fines up to $25,000 per year and/or one year in jail for each of the above years not filed. Each letter demanded the filed returns within 90 days.

In December of 2004, Mr. Little wrote another letter to the new "Catholic" Prime Minister, Paul Martin. It is reproduced here:

Dear Mr. Martin,
I pray for you regularly. Prayer is the first thing. But for this situation, it is not enough. I cannot allow this year to end without expressing my sadness, anger and disgust with your leadership regarding the institution of marriage in Canada. You claim yourself a Catholic. Yet you support abortion, even tax-funded abortion in our public hospitals and the re-definition of marriage. You allowed without comment, a Catholic bishop, Fred Henry, Bishop of Calgary to be intimidated and threatened by the revenue agency during the last election campaign because he openly questioned your fitness to receive the Eucharist while publicly and scandalously supporting abortion. Why don't you just leave the Church if you cannot believe and follow its teachings? It is the foulest of hypocrisy to hold something in conscience and support the opposite in public.
To say that you personally are morally opposed to abortion or same-sex 'marriage' but can't force your morality on citizens is logically absurd as well as immoral. You are personally opposed to child abuse and theft, are you not? Yet you force your morality on others in those cases. All law reflects moral judgment. The point is that for Catholics, the Church is the judge of morality, not me, not you. You supplant God's will when you say that the 'Charter' is all governing, most important. The 'Charter' is written by men and women. It is interpreted by (unelected) men and women. The 'Charter' is not God and has not His authority. The commandments are revealed by God and interpreted by God (The Holy Spirit) in His infallible magisterium, through His Church. To legislate same-sex marriage is a "serious and sustained attack on the marriage-based family, a union of love and life between a man and a woman from which life naturally results...Upon this matrimonial link, a necessary good, all societies are solidly based. To deny this fundamental and elemental anthropological truth would lead to the destruction of the social fabric." (Pontifical Council for the Family)
There are moral absolutes. There is sin. There is right and wrong. Times may change but absolute moral values do not change. The Church has always taught that there are three things that cry out to God for vengeance: murder of the innocent, sodomy and oppression of the poor. Murder is always wrong and abortion is the murder of an innocent child. Sodomy is always wrong. Sodomy is a perversion of nature. The Supreme Court cannot avoid absurdity by ruling otherwise.
To analogize as to how absurd, suppose the Supreme Court of Canada rules that the earth discriminates because its axis provides more warmth in the southern hemisphere. That is absurd isn't it? Because God designed immutable natural laws that govern astronomy, earth's axial rotation, the seasons, animal, vegetable, mineral and human nature. No one should need be told that the Supreme Court cannot change nature by some pretentious fiat.
Marriage is a covenant between a man and a woman to love each other in total giving exclusively, and cooperates with God to create new life. Homosexuals cannot therefore marry because there is no possibility for them to create new life except through some Machiavellian scientific experiment which even now is being discussed, by mixing 2 male sperms and injecting them into an ovum!
Mr. Martin, the first priority ought be to amend the constitution to define marriage as a covenant between one man and one woman to the exclusion of all others.
Otherwise hold a national referendum after a thorough public debate but do not rush into this legislation without weighing all the consequences, social, educational, judicial, moral and economic.
At the very least, when an issue that places at risk the fundamental pillars of civilization, marriage and the family, do not be demagogic, give all MPs a free vote, including ministers.
It is wrong to appease those who would corrupt marriage and the family and it is very dangerous for society. What's next? Child marriage? Incestuous marriage? Polygamy? Child polygamy? Churchill said, "An appeaser is one who feeds a crocodile, hoping it eats him last." Mr. Martin, don't just appease. This is not about human rights. It is about human nature. It is about normality. Something is normal when it is being used for that which it is designed. Men and women are designed to marry and procreate. Same gendered persons are not so designed. This doesn't mean society should tolerate hateful acts toward homosexuals. Human dignity must be respected in all persons. But perverse and abnormal acts should not be falsely institutionalized as 'marriage'. Most Canadians and myself, do not want that behaviour characterized as marriage. Marriage is a sacred and holy covenant, a sacrament for me and for millions in Canada and the world. It is profoundly sacrilegious to allow abnormal sexual acts to be called marriage, whether civil or religious.
Finally once more, I ask you to decide whether you are a Catholic or not. You cannot remain a Catholic and receive the Body and Blood of Christ while advocating or voting in support of same sex 'marriage', abortion, embryonic stem cell research, and other issues that oppose official Catholic teaching. To do so is heresy. Decide. Please conform to real Catholicism not the cafeteria brand. If you do not convert, then please have the integrity not to receive Communion at Mass. I will continue to pray for you.

Three weeks later in January, 2005, a subpoena was delivered personally to Mr. Little at his home. For unknown reasons, only three of the five years were charged in the document, 2000, 2001 and 2002. It stated that he must appear in Provincial Court in Fredericton on February 2nd. He did so after garnering some preliminary legal advice and obtained an adjournment till March 2nd. On that date he was ordered to enter a plea on April 13th. Strategic legal response is being prepared and will be kept private till that date.
